When to contact us
An inheritance must be accepted within three months. When you live abroad, are ill or did not know about the estate, the deadline is often missed – but it can be restored.
- More than three months have passed since a relative’s death.
- You live abroad and could not contact a notary in time.
- You learned about the estate or your rights too late.
- Other heirs have already accepted the inheritance.
- A notary refused to issue a certificate of inheritance.
3months
The deadline to accept an inheritance from the day it is opened.
A court may restore a missed deadline if it finds it was missed for important reasons. An inheritance may also be accepted without court if all other heirs who accepted it agree.
Civil Code, Articles 5.50 and 5.57
